Elections Board: Attorney General Can Defend It In Lawsuit

North Carolina's State Board of Elections & Ethics Reinforcement says the attorney general can defend it against a lawsuit brought by the governor in any way he sees fit, even if it means backing the governor.

The News & Observer reports the 5-4 vote, divided along party lines, was taken Saturday during a special session by telephone and involves Attorney General Josh Stein supporting Democratic Gov. Roy Cooper's position.

Cooper is suing the board and legislative leaders to keep two of six proposed constitutional amendments off the fall ballot.

Meanwhile, North Carolina's five living former governors are meeting to oppose constitutional amendments on November ballots that would swing powers involving judicial vacancies and state boards from the executive branch to the legislature.

Montgomery Picked To Replace Hanes In House

Forsyth County Democrats have chosen a Winston-Salem city councilman to fill the unexpired term of Ed Hanes in the North Carolina House. The council will now have to pick a successor to Derwin Montgomery.

Party leaders, many from House District 72, chose Montgomery over fellow nominee Annette Scippio. He's spent nine years on the city council, but says the move to the statehouse will give him a chance to tackle some different concerns.

Hanes announced last week that he's stepping down. 

Montgomery was also tabbed to take Hanes' place on the November ballot.

With his departure, the city council will now be given a chance to choose Montgomery's replacement.

North Carolina Elections Office Looking At Registration Drives

North Carolina election investigators are looking into alleged misconduct involving voter registration drives in several counties.

The State Board of Elections & Ethics Enforcement said Friday it had received reports that individuals were wrongly telling voters in New Hanover, Pitt and Robeson counties that they had to register again to cast ballots in November.

The board says that's not necessary unless a person has moved or changed their name or party affiliation, and that individuals can go online to check their registration.

A board release also says they've heard about people falsely identifying themselves as county or state election workers going to homes and businesses. And the agency investigated in recent months allegedly falsified registration documents delivered to county elections offices.

3 North Carolina School Board Members Now Resigning Next Month

Next month's departures of three State Board of Education members will give Democratic Gov. Roy Cooper the ability to fill vacancies without his replacements having to win formal North Carolina General Assembly approval.

Greg Alcorn was the latest to announce his resignation, effective after the September board meeting. Chairman Bill Cobey and member Becky Taylor announced similar resignation decisions last week.

All three were appointed by then-GOP Gov. Pat McCrory to terms that expire next March 31. Cooper can appoint people to complete the remainder of those terms.

I-40 Lanes To Be Closed As Pedestrian Bridge Comes Down

There are more delays and detours in store for a part of Interstate 40.

The N.C. Department of Transportation says contractors will demolish a pedestrian bridge that crosses I-40 just west of the Yadkin River near Bermuda Run beginning Monday.

Work on the Berts Way bridge is taking place as part of ongoing construction to replace the I-40 bridges over the Yadkin River. It also is meant to widen and improve I-40 in the area.

The contractor will close the left lane of eastbound I-40 for set-up work around 6 p.m. Monday. The contractor then will close the left lane of westbound I-40 for set-up work around 7 p.m. Thursday.
